Terms of Service
These terms govern your use of the Artify Lab apps for iPhone, iPad and Mac, and of artifylab.app.

Agreement to these Terms
These Terms of Service ("Terms") form an agreement between you and [[Artify Lab — registered entity name]] ("Artify Lab", "we", "us") covering the Artify Lab apps, this website, and everything we offer through them (together, the "Service").
By downloading, opening or using the Service, you accept these Terms. If you do not agree with them, please do not use the Service.
Your purchases are additionally governed by Apple's App Store terms. Where Apple's rules conflict with these Terms in respect of a purchase, Apple's rules apply to that purchase.
Who can use Artify Lab
You must be at least 13 years old and old enough to form a binding contract where you live. If you are under 18, you may only use the Service with the involvement of a parent or guardian who accepts these Terms on your behalf.
You may not use the Service if applicable law bars you from doing so, or if we have previously terminated your access.
Credits and purchases
Artify Lab has no subscription. Generating images consumes credits, which you buy as a one-off in-app purchase through Apple.
- Credits are a limited licence to use the generation features of the app. They are not money, they carry no cash value, and they cannot be exchanged, resold or transferred.
- All purchases are processed by Apple. Prices, taxes and receipts are handled by the App Store, and Apple's refund policy applies.
- A generation consumes credits when it is submitted. If a generation fails for a technical reason on our side, we return the credits it consumed.
- Credits are tied to the Apple Account that bought them and are available on the devices signed in to that account.
- We may change credit prices, or how many credits a feature costs, going forward. Changes never apply retroactively to credits you have already bought.
Refund requests go to Apple, not to us. We are happy to help you work out what happened, but we cannot issue App Store refunds ourselves.
Your content
"Your Content" means the prompts you write, the reference images you provide, and the images the Service generates for you.
You keep ownership of your prompts and of the reference images you bring, provided you have the right to use them. As between you and us, we claim no ownership of the images you generate: you may use them personally or commercially, subject to these Terms and to the law where you are.
You grant us a limited licence to host, process and transmit Your Content only as far as running the Service for you requires — generating the image, delivering it to your devices, providing support you ask for, and complying with the law. We do not use Your Content to train generative models.
Because generative models produce similar output from similar input, we cannot promise that an image you generate is unique, or that someone else will not generate something like it.
Rules of use
Do not use Artify Lab to create or distribute:
- sexual content involving minors, or any depiction that sexualises a minor;
- non-consensual intimate imagery, or sexual content depicting a real person without their consent;
- content that harasses, threatens, defames, or incites violence against a person or group;
- deceptive depictions of real people, organisations or events presented as genuine — including political disinformation, forged documents, and fabricated records;
- content that infringes someone else's copyright, trademark, likeness or other rights;
- content that breaks applicable law or Apple's App Store guidelines.
You also agree not to reverse engineer, decompile or interfere with the Service, to circumvent its limits, credit system or safety filters, or to access it through automated means we have not published.
We use both automated and manual measures to enforce these rules. We may refuse a generation, remove content, or suspend or end access when we reasonably believe these rules have been broken.
AI-generated output
Images are produced by machine learning models. Output can be inaccurate, unexpected, or unlike what you described, and it may reflect biases present in the data the models were trained on. Treat what the Service produces as a creative draft, not as a statement of fact.
You are responsible for reviewing anything you publish or rely on, and for making sure your use of it is lawful where you are. Copyright in AI-generated images is treated differently from country to country, and we make no representation about what protection, if any, your generated images attract.
The app itself
The Service, its software, design and brand are owned by us or our licensors and protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the apps on devices you own or control, as permitted by the App Store terms.
The Artify Lab name and logo may not be used without our written permission.
Third-party services
Running the Service depends on third parties — Apple for distribution, payments and iCloud sync, and AI infrastructure providers for image generation. How they handle data is described in our Privacy Policy. We are not responsible for third-party services we do not control.
Availability and changes
We work to keep the Service available, but we do not promise uninterrupted or error-free operation. We may add, change, suspend or withdraw features. If we discontinue a feature you hold unused credits for, we will provide a reasonable alternative use for those credits or, where the law requires it, a refund.
Termination
You can stop using the Service at any time by deleting the apps. We may suspend or end your access if you break these Terms, if the law requires us to, or if continuing would create a serious risk for us or for other people. Unused credits are forfeited if we end your access for a breach of these Terms.
Sections that by their nature should outlast the agreement — ownership, disclaimers, limitation of liability, indemnity and governing law — survive termination.
Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
Some jurisdictions do not allow certain warranties to be excluded, so parts of this section may not apply to you. Nothing here limits consumer rights that cannot be limited by law.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or USD 50.
Indemnity
You agree to indemnify us and hold us harmless from claims, damages and reasonable legal costs arising from Your Content, from your use of the Service, or from your breach of these Terms — except to the extent the claim arises from our own wrongdoing.
Governing law and disputes
These Terms are governed by the laws of [[jurisdiction]], without regard to conflict-of-law rules, and the courts of [[jurisdiction]] have exclusive jurisdiction. If you are a consumer, you keep the right to bring proceedings in the courts of the country where you live, and the mandatory consumer protections of that country continue to apply to you.

Changes to these Terms
We may update these Terms. When we make a material change we will revise the date at the top of this page and, where the change meaningfully affects you, give notice in the app. Continuing to use the Service after a change takes effect means you accept the updated Terms.
